Sobre la Ley de amnistía: criterios jurídicos y políticos = On the Amnesty Law: legal and political criteria

[ES] La Constitución ofrece una serie de criterios jurídicos para evaluar si las disposiciones de la ley española de amnistía de 2024 son compatibles con sus mandatos. Sin embargo, la justificación de esas disposiciones expuesta en el mismo texto de la ley se refiere a criterios políticos, como la conveniencia de una política de reconciliación civil en Cataluña y de un tratamiento benévolo (esto es, de un perdón) a aquellos implicados en el movimiento secesionista de 2017. El presente artículo examina hasta qué punto el análisis y evaluación constitucional de la ley (que eventualmente deberá llevar a cabo el Tribunal Constitucional) puede o no versar sobre la compatibilidad con la Constitución de esa justificación política. [EN] The Constitution provides a series of legal criteria for evaluating whether or not the provisions of the Spanish Amnesty Act of 2024 adhere to the Constitution's man-dates. However, as stated in the text of the Act, the justification for these provisions is based on political criteria, such as promoting a policy of civil reconciliation in Catalonia, as well as affording lenient legal treatment (i.e., pardon) for those involved in the 2017 secessionist movement. The present article examines to what degree a legal-constitutional analysis and evaluation of the law (eventually to be performed by the Constitutional Court) can or cannot examine whether this political justification is constitutional.
