  • I Introduction: Spain's employment and productive statuses Traditionally, Spanish legislation has set the limits of the employment relationship through three different notions, which have emerged successively with the evolution of the labour market. As a consequence, the Spanish legal framework for the employment relationship could be described as a 'three-tier system' or as an 'obtuse triangle' because it is formed by three elements, even though these elements are of different importance. Similarly to an obtuse triangle, in which one of the angles is larger than the others, in this three-tier system, the importance of the employment relationship significantly exceeds, from a legal point of view, the importance of the other two elements. Hence, the element to be examined first is, logically, the employment relationship, represented by the concept of 'employee'.
