  • Este artículo tiene como finalidad realizar un análisis crítico del subtipo agravado de hurto por multirreincidencia contemplado en el art. 235.1.7º del Código Penal, con el objetivo de elaborar una propuesta legislativa que proteja correctamente el patrimonio de los ciudadanos, acorde con los principios de culpabilidad y de proporcionalidad, pero teniendo en cuenta además las circunstancias del autor, para que todas las conductas de hurto ejecutadas de manera reiterada queden sancionadas adecuadamente, y a la vez sea un eficaz instrumento para la reeducación y reinserción social de las personas que hacen de este ilícito su medio de vida.
    This article aims to perform a critical analysis of the aggravated subtype of theft by multireincidence contemplated in art. 235.1.7 of the Criminal Code, with the aim of drawing up a legislative proposal that correctly protects the citizens patrimony, in accordance with the principles of guilt and proportionality, but also taking into account the author circumstances, so all theft conduct that are carried out repeatedly should be adequately sanctioned and at the same time an effective instrument for the re-education and social reintegration of the people who make this illicit their way of life.
