El Ingreso Mínimo Vital desde la óptica del derecho público: sus aportaciones al debate sobre el Estado social y autonómico

El Ingreso Mínimo Vital ilustra muy bien el dinamismo propio del Estado social y el protagonismo que en él cobran las cuestiones organizativas y procedimentales. De un lado, recompone la distribución de competencias y el sistema de prestaciones de la protección social, en un proceso complejo e inconcluso en el que participan el Estado, las comunidades autónomas y los entes locales. De otro lado, se dota de procedimientos cuya idoneidad se revela crítica para la eficacia de la prestación y que sirven de referencia útil para replantear el concepto mismo de procedimiento administrativo. = The Minimum Living Income illustrates very well the dynamism of the social State and the prominence that organizational and procedural issues have in it. On the one hand, the MLI recomposes the allocation of powers and the elements of the system of social protection, in a complex and unfinished process in which the State, the regions and the local entities take part. On the other hand, the provision of the MLI requires procedures whose suitability is revealed to be critical for the effectiveness of the measure and which serve as a reference to rethink the very concept of administrative procedure.
