  • This work has to be placed in the context of the confrontation between tradition and progress that feeds the passionate and tense ideological debate staged in the years preceding and during the establishment of the Second Spanish Republic. It examines the intense controversy that arose between those who advocated a profound renewal of the selection criteria and preparation requirements of those entering the magistracy and those who opposed their proposals in defense of a corporate dignity that they felt was directly attacked. What was at the heart of the discussion, however, was the confrontation between those few, like Francisco Beceña -a decisive figure in the initial stage of development of Spanish procedural science- who began to perceive the serious defects in judicial organization as a big obstacle on the road to a necessary and urgent improvement in the administration of justice and those who, fearful of the scope of the reform, were inclined to maintain the old and outdated structures.
