  • La presente investigación tiene por objeto el estudio del último de los instru- mentos de reconocimiento mutuo en materia penal, la orden de investigación europea, en concreto en este artículo se analiza la implementación de la Directiva 2014/41/CE, del Parlamento Europeo y del Consejo de 3 de abril de 2014, por el legislador español a través de la Ley 3/2018, de 11 de junio, centrándome fundamentalmente en las disposiciones generales relativas a la orden de investigación europea relacionándolo con los problemas que puede conllevar su práctica tanto desde el lado del Estado emisor como del lado del Estado de ejecución, por tanto, no tiene como objeto de estudio las disposiciones específi cas relativas a determinadas medidas de investigación que la Ley le concede un régimen especial, sin perjuicio de que pueda a lo largo del trabajo referirme a ellas./The scope of the present research is to study the last instrument for the muual recognition in criminal matters, the European Investigation Order. In particular, this article analyses the implementation of Directive 2014/41/CE, of the European Parliament and the Council of 3 april 2014 by the Spanish legislator through Act 3/2018, of June 11, focusing mainly in the general provisions regarding the European Investigation Order and connecting them with the problems that its execution may entail, both on the side of the issuing State and on the executing State. Therefore, its focus is not the study of the specific legal rules regarding particular investigating measures that receive a special treatment by the law, notwithstanding the fact that I may refer to them in this article.
