  • At the end of September 2016 the CJEU issued a judgment (Case Essent Belgium) in a preliminary ruling interpreting Articles 3 and 4 of Directive 2001/77 (national support mechanisms for green electricity); 3.2 and 16 of Directive 96/92; 3.3, 8 and 20.1 of Directive 2003/54 (internal electricity market); And Articles 28 and 30 of the EC Treaty (free movement of goods). The judgment is important because it considered that a regional law which excludes from the energy advantages renewable electricity produced outside the national territory is incompatible with the law of the EU. Essent Belgium, can be described as a major jurisprudential turn in the orientation of national energy policies and their compatibility with European standards in the field.
